Transactions between customers and BINIS ALPHA on the Websites

Through those sites, BINIS ALPHA provides an electronic Web platform for exchanging information and concluding sales and purchases of products and services online between customers and BINIS ALPHA. BINIS ALPHA reserves the right to limit certain functions and features of the platform to prescribed members. Each member acknowledges that they assume the full risks of buying and selling transactions when using the site to conduct transactions. Such risk includes but is not limited to, misrepresentation of products and services, fraudulent schemes, unsatisfactory quality, failure to meet specifications, defective products, delays in delivery or payment, miscalculation of costs, breach of warranty, breach of contract and electronic traffic (“Transaction Risks”). BINIS ALPHA will try and make maximum efforts to minimize the risks of the transaction as far as it is in its power, which refers to misrepresentation of products and services, fraudulent schemes, non-fulfillment of specifications, defective products, delays in delivery, miscalculation of costs, breach of warranty, breach of contract and electronic traffic.

Each member agrees that BINIS ALPHA shall not and shall not be liable for any damages, debts, costs, damages, inconveniences, business disruptions, or expenses of any kind that may arise as a result of or in connection with any transaction risks. Members are solely responsible for all terms of transactions conducted on, through or as a result of the use of the Site, including, without limitation, terms related to payment, returns, warranties, shipping, insurance, fees, taxes, title, licenses, fines, permits, handling, transport, and storage.

The member agrees to provide all information and materials that BINIS ALPHA may request in connection with transactions made through the transaction platform on the site. BINIS ALPHA has the right to terminate or suspend any member’s account if the member does not provide the necessary information and materials. In the event any Member has a dispute with a transaction, such Member agrees to release and hold harmless BINIS ALPHA (and our agents, affiliates, directors, officers, and employees) from all claims, demands, actions, proceedings, costs, damages (including without limitation of any actual, special, incidental, or consequential damages) arising out of or in connection with such transaction.

Each member acknowledges that they are solely responsible for all data, text, software, music, sound, photographs, graphics, video, messages, or other material (“Content”), whether publicly or privately transmitted through discussion boards on the site. BINIS ALPHA provides online transaction systems and relevant technical services to support customers and conclude online transactions (collectively, the “Services”). When customers conduct transactions over the Internet, they must comply with these rules and the end user agreement and terms and conditions. The buyer has the obligation to confirm the agreement regarding the above transaction and agree in good faith with the terms of trade i.e. product number, price, product function (e.g. specifications, materials), selected payment, delivery time, place, and method, as well as product inspection and receipt. To maintain a fair-trading environment and proper order, in relation to those contracts that are concluded to gain illicit interests or are untrue or dishonest, BINIS ALPHA may exclude or penalize users and those transactions and orders involved in such actions at its sole discretion. discretionary right.

After the contract is confirmed, customers should complete the payment process according to the terms of BINIS ALPHA. –disputes and transaction mediation

BINIS ALPHA has the exclusive right to determine whether to accept the appeal in relation to the relevant dispute by the relevant rules. In such a dispute, the user who initiated the complaint related to the transaction dispute submits a request. If the complaint does not provide relevant supporting documents within the required time or the supporting documents submitted by the complaint are insufficient to substantiate the claims, BINIS ALPHA has the right to refuse to accept the complaint and close the case accordingly without further explanation to the complainant.

As BINIS ALPHA is not a professional dispute resolution institution and has limited capacity to identify evidence and resolve disputes, BINIS ALPHA does not guarantee that the results of the dispute resolution will meet the customer’s expectations, nor will it be responsible in any way for the results of the dispute resolution.

In the event of any inconsistencies between the English and Serbian versions of these rules, end-user agreements, and terms and conditions, the Serbian version shall prevail.

–Delivery

All orders in Serbia are generally delivered by post express and/or other them by courier services and/or postal service. International orders can be shipped with an international courier (FedEx, DHL, UPS, among others). Domestic orders are delivered with a domestic courier. At our discretion, we do not deliver to PO Boxes. All goods will be shipped to the address provided by the user and the person ordering any product/goods/services from the Websites. All customs inspection costs (if any) are borne by the User (“Customer”, “User”, “Member”). You should know that customs policies vary from country to country. We advise any customer to contact their local customs office for further information if they are in any way unsure of local duties or obligations. BINIS ALPHA may post on the website an estimated and estimated order preparation and delivery time. If you are placing multiple orders or one order for multiple customers and shipping addresses, please note that we will ship one order to one address. All costs of international transport are paid by the buyer outside of Serbia before delivery.

The customer fully accepts that we have no influence on the delivery time and that we bear no financial or moral responsibility for possible delivery delays. The customer can submit requests for a refund of any part or the full amount paid following the Law on Consumer Protection in Serbia. We try to always meet the customer. The customer accepts the goods and products “as is” and as described, which means that he cannot expect unrealistic features of the goods (for example, he cannot expect from the product “cake figurines” that they will replace his cake). In some cases, we cannot accept returns. The customer can request a refund if he receives goods he did not order. The customer cannot request the return of the goods if he changes his mind and uses the goods in the meantime. By using the goods, it is also understood that he opened the packaging in which the goods were packed.

Factors such as shipping method, courier, and/or your location may affect delivery time. “Ready to Ship” time may vary due to different processing times for different items. Some unavoidable reasons may affect this. The customer unconditionally accepts a delay of 10 days after the scheduled delivery time. The customer agrees that no refund or suspension will be requested for that period. For package delivery information, you must visit the chosen courier’s website and follow the instructions on their website. Different items have different shipping costs. Check with the courier. You must visit the selected courier’s website to view shipping rates, as shipping rates may vary by weight, volume, and value of the shipment.

For customers outside of Serbia, we can deliver products from warehouses in Serbia, the USA, Europe, and China, depending on the place of production of the selected product. Since it is shipped from different warehouses in different countries, with different couriers, please allow up to 60 (sixty) days before opening a dispute.

–customs duties and import taxes

It is always the buyer’s responsibility to pay the relevant customs duties. Following the laws of the Republic of Serbia and as required by the laws for domestic and international customers and members, we add taxes and VAT or not and we are not in the VAT system. You pay the price on the website. However, you must pay taxes or customs duties on imported goods in your country. The customer must find the information before ordering. If you must pay import taxes and/or additional customs duty and sales tax, then you have to pay it to the courier after receiving the package. The buyer is responsible for the customs and taxes of the country in which he lives.

The Owner provides this service based on the following terms and conditions. The parties to this agreement are the users of the complaint center (hereinafter referred to as “users”) and BINIS ALPHA (hereinafter referred to as “BINIS ALPHA”, “Binis”). Complaint Center (hereinafter referred to as the “System”) – means the computer software program developed by BINIS ALPHA and/or downloaded from third parties to allow users to log into the system and report transaction disputes, product information for violations of our policy, etc. User – means any person (whether individual or entity) who uses the system to report or respond to complaints.

This agreement includes all rules published by BINIS ALPHA on the websites. All such rules form an integral part of this contract and have the same legal effect as is the basis of this agreement contained in this document. When using the system, the user promises to accept and respect all rules. BINIS ALPHA reserves the right to amend and modify this agreement and any related rules at its sole discretion from time to time without notifying the user of the changes. If the user does not accept the relevant changes, he should stop using the system. Upon publication of the amended agreement, it shall enter into force immediately. All related rules, which also form part of this agreement, will be effective upon their posting. If the user logs in or continues to use the system, he will be deemed to have accepted the amended agreement. Unless otherwise expressly stated, any new content that expands the coverage of the system or improves its functionality is subject to this agreement.

The user should read this agreement carefully before using the system. Regardless of whether the user read this agreement carefully before using the system, as long as he clicked on the “confirm” button at the bottom of the order page or shopping cart, the user is considered to have agreed and entered into this agreement and the entire final agreement to users of the document.

When submitting a complaint, the user is obliged to provide correct information and guarantee the validity and security of such information as e-mail address, phone number, address, etc., and to ensure that BINIS ALPHA and the complaining party can contact him through the provided contact information. In addition, the user must send a written notification to BINIS ALPHA immediately, and no later than eight days) after any changes to the relevant information.

When the system shows the successful forwarding of the appeal, it only means that the user has completed the submission of the appeal following the procedures prescribed by the system and it does not necessarily follow that BINIS ALPHA will accept the appeal or the settlement of the appeal request.

When the information submitted meets the complaint standards, BINIS ALPHA will respond to the complaint within a reasonable time. BINIS ALPHA has the right to modify the response period in light of the actual situation. BINIS ALPHA would forward the received details of the claim to the respondent and ask him to respond within a reasonable period. If the defendant submits counterarguments, the user can raise the complaint to the BINIS ALPHA dispute level. At any time during the appeal process, BINIS ALPHA has the right to require the user to complete any information or provide any additional material related to the appeal. After receiving a request for additional information related to the complaint, the user must provide the relevant information on time following the requirements of BINIS ALPHA. If there is a failure to do so, BINIS ALPHA shall be entitled to treat the complaint as if it had not been filed.

—customer declarations and guarantees

The user warrants that he has the legal right, is subject to the law, and has the right and ability to file complaints legitimately. BINIS ALPHA has the right to consider how to deal with said notices. The entire procedure related to the complaint that is processed in the system follows the national laws of Serbia, regulations, and relevant provisions, as well as all relevant aspects of social and public interests or public morals. User agrees not to use any information from the system for any purpose other than processing and resolving related complaints. The user agrees to receive emails and information from BINIS ALPHA and its affiliates.

—termination or change of use of the system

BINIS ALPHA has the right to terminate any use of the system at any time, without further notice for the following circumstances: the user violates any provision of this agreement; the material submitted by the user for the complaint is false or contains anything false or illegal; The user expressly indicates his unwillingness to accept the new or corrected agreement; Any circumstances that BINIS ALPHA may in its sole discretion deem necessary to terminate the use of the system.

After termination of use, BINIS ALPHA has no obligation to retain information related to the complaint after termination of use of the system. BINIS ALPHA has the right to delete information after a reasonable time determined by BINIS ALPHA. Regardless of how BINIS ALPHA terminates the use of the system, BINIS ALPHA reserves its right to: keep or not keep the user’s login on record; take appropriate action against a user who has violated this agreement or engaged in any illegal behavior before termination of use of the system.

The user agrees that BINIS ALPHA may change or suspend part or all the functionality of the system and the use thereof and delete any material users submitted to the system without notice to the user or the use of the user and from an independent producer. User understands that BINIS ALPHA must maintain and/or may repair the system and/or its associated equipment on a regular or extraordinary basis. BINIS ALPHA bears no responsibility to the user for any delay or suspension of the use of the system in these situations. If the user does not agree with any change in this contract, he is free to stop using the system. If the user continues to use the system, he will be deemed to accept any changes to this agreement.

BINIS ALPHA can deliver notifications to the user on the pages, via e-mails, short messages (“SMS”), regular mail messages, etc. The user is deemed to have received the notice with the publication date in one of the above ways. This agreement will be interpreted and governed by the laws of Serbia and any dispute arising will be submitted to Serbian courts.

—Return & Exchange & Refund

It is very important to us that your shopping experience is positive and satisfactory. If you are not satisfied with your purchase or if it arrived damaged, please write to us and we will try to fix the problem as quickly as possible. Replacement, return, and refund of products are carried out following the law on consumer protection. Many products ordered by a customer are custom-made for that customer after their order confirmation. The user could exchange the product free of charge, only if he received the wrong product due to our mistake, and within 24 hours of receiving the product with a previously written complaint. After the expiry of that period, it is considered that the customer has no objections to the product and has decided to keep it. The customer agrees and will not request a refund if the colors on the product received are not identical to the colors on the product images on the Website. Colors may vary due to monitor resolution and quality and other technical factors on the website. The customer agrees and accepts and will not under any circumstances request a refund if the dimensions of the product differ by up to 5% (five percent) of the dimensions printed on the product website.

Return and refund of the digital product is not possible. Product returns are possible within 14 days under certain conditions following the Law on Consumer Protection in Serbia. To be eligible for a refund, the product must be unused, unopened, undamaged, and in the same packaging it was sent in. The product must be in its original packaging. The product must have an invoice as proof of purchase. The shipping costs of product returns are paid by the Buyer. When we receive the product back, we will inspect it and notify you that we have received the returned product. We will notify you of the refund status once we have reviewed the product and its packaging. If your refund is approved, we will initiate a refund to your card (or original payment method). You will receive a refund within thirty working days less the amount of delivery of the shipment to the customer and the costs of the bank and payment processors. So, we will refund the amount you paid for the price of the product, while courier delivery costs and bank and financial intermediary costs (bank and payment processor costs) cannot be refunded. If the original packaging of the product is opened or damaged, and the product itself has not been used, the customer can, at the sole discretion and non-binding right of BINIS ALPHA, receive partial compensation in the amount of 50% of the product price. If the product packaging has been opened or damaged, refunds will be refused in full.

You are responsible for paying your costs for returning your item. Courier delivery costs, and bank and payment processor costs are non-refundable. If you receive a refund, those charges will be deducted from your refund. If you have questions about how to return a product to us, please contact us. The customer can exchange the paid order for another product of the same or higher value (if the value of the new order is higher, the customer must pay the difference in money) without penalty only for the first 6 hours after we receive the paid order. If the customer wants to exchange the product after receiving the product, due to personal reason, the customer must contact us and the decision is at the discretion of BINIS ALPHA, but the customer is responsible for the shipping costs for both products (the item from the customer to BINIS ALPHA and the other from BINIS ALPHA to customer) and we have the right to retain up to 50% of the value of the item. To exchange an item or change a paid order, the customer must notify us via email. Those goods must be returned to us unopened within 7 days of cancellation and must be received by BINIS ALPHA unopened and sealed in their original packaging in a condition suitable for resale. We cannot exchange opened products or opened packaging. Returned goods must bear the original invoice. Following the Law, edible products, products that are specially made for the customer as well as digital products cannot be returned. Please note that customs may open and check the package.

After you hand over the product to the courier, based on the delivery option you use, you may or may not receive a tracking number via the email address you provided us. From the time the courier receives the product from us, that product is the responsibility of the courier. If the delivery fails because the address provided by the customer is incorrect or incomplete and the item is returned to BINIS ALPHA, we will notify you and ask for your correct address and resend to you at your expense or agree with you not to resend and refund 50% product prices. If the customer needs the product, he must pay the shipping cost and we will re-ship it to the right address. If the delivery fails and the item is not returned to us, we cannot issue a refund. If the product is held at customs, the buyer is responsible for customs costs.

For refunds, we require the item’s serial number, a photo of the shipping label on the original package. A damaged product cannot be returned, whether the damage was caused by the customer or by a third-party during transport to the customer. All returned items must be in brand new, unused condition. Products made exclusively for the customer (e.g. customer logo on the item) cannot be returned/canceled/refinanced in any case. For a product that is made specifically and especially for the customer, it cannot be used in the option for the possibility of returning the cost of the item. No refunds can be requested for edible products. Digital products cannot be refunded.

If the payment for the order has not yet been completed, the customer can cancel by clicking the “Cancel order” button on the customer’s account. If the order is not paid for by the next day, it will be automatically canceled. If the order is canceled within 6 hours of payment, we will return the funds to you in the reduced amount of the bank rate and transfer. If the order is canceled within 12 hours of the paid order, we will refund 50% of the funds in the amount of cash fees and transfers. After 24 hours of the paid order and for a product that is not in return, the customer cannot cancel the order, the customer cannot request a refund while the goods are in transit. Delivered orders cannot be canceled.
